The firm pursues and defends against claims involving C.E.R.C.L.A. litigation, R.C.R.A. litigation and other hazardous waste related matters, including actions to compel a defense and settlement with underlying insurance carriers.
The firm successfully completed the settlement of claims for environmental damage alleged in the ARCO/Sand Springs petrochemical complex suit - brought against the firm's client (a transporter of petroleum) during the pendency of Federal Court C.E.R.C.L.A. litigation. All insurance companies of the transporter client disputed insurance coverage for the defense or indemnity of environmental claims. However, following suit against those insurance carriers, the carriers paid for all defense costs and provided settlement sums to resolve the case. Lead counsel in both the environmental suit and insurance coverage suits: Steven M. Harris and Michael D. Davis
